Buyback vehicles refer to vehicles that are repurchased by a manufacturer due to a state lemon law. New motor vehicles sold or leased to consumers are covered by Lemon Law. The manufacturer may either reacquire the defective vehicle (buy it back) or replace it when a consumer prevails under Lemon Law.
After the manufacturer reclaims the vehicle, the defect can be repaired, and the vehicle may then be sold or leased. A notice form must be provided by the manufacturer to the dealer who reacquires the vehicle. This form must enumerate the reasons for the reacquisition. In turn, a prospective consumer must have the opportunity to read the notice before they buy or lease a new vehicle acquired.
The notice needs to be signed and dated by both, the dealer and the consumer, and the original handed over to the consumer. The manufacturer should also provide warranty for the original problem that was the defect that caused the reacquisition for the period of one year, or 12,000 miles, whichever happens first.
A branded title refers to the condition of the vehicle. The title of a vehicle could be “salvaged, flood”, “water” “total losses”, or “fire”. A vehicle is taken to be salvaged when 1) two or more parts of the vehicle have to be replaced, to make the vehicle operable again; or 2) a ‘total loss’ claim has been paid by an insurance company, and the vehicle hasn’t been repaired; or 3) damage has been caused to an imported vehicle during shipment, and has never been up for retail sale, nor has been issued a title 4) When the vehicle has been titled and branded by another state, as Fire, flood, water, or total loss. Salvaged vehicles are not allowed to operate legally on public roads.
