After a car accident, you may need to hire an auto accident attorney to receive the most compensation. But what about auto accident attorney fees? What do you have to pay to hire an auto accident attorney?

The first thing to know about auto accident attorney fees is that you typically do not need to pay attorney fees up front. Let’s face it: Many attorneys bill you at hundreds of dollars per hour, so how could most injured people afford such expenses? The good news is you do not usually need to. Most personal injury attorneys charge a contingency fee for their work. This means if they get you a settlement, you will pay them a percentage of the money you receive.

For example, if your attorney gets you a $100,000 settlement, you would pay a percentage of that money at the end of the case. Many attorneys charge a contingency fee of 33%, so you would pay approximately $33,000 in attorney fees. You also would need to pay the attorney’s expenses from the case. Some of these may include expert witness fees, accident reconstruction fees, deposition fees, copying fees, and more. Most personal injury clients do not need to pay these out of pocket, so there is usually little reason to not hire a personal injury attorney if you have a case.

There also is a sliding scale option with some personal injury law firms. This means that the auto accident attorney fees depend on when the case is resolved. For example, your lawyer may agree to take a 25% contingency fee if the case is resolved by negotiating with the insurance company. But if your attorney has to file a personal injury lawsuit in court before the settlement is accepted, you may have to pay a 33% fee, or even 40% if the case is set for trial. The closer the case gets to trial, the more the attorney has to do, and the higher the fee will be.

What happens if the attorney loses your case? For the most part, personal injury attorneys get some sort of settlement or favorable verdict in most cases they accept. They are picky about the cases they take on because if they do not win, they will not get paid.

You and your lawyer must have a clear understanding of who will pay expenses and costs if you do not win. Some attorneys will agree not to make you reimburse them for costs if they do not get you anything. Or, you could split the costs with the lawyer, or you could agree to reimburse them. Whatever the case may be, everything should be spelled out in writing at the start of the case.

When you sign on with your personal injury attorney, be sure that you know about the auto accident attorney fees and how and when you will pay. Most attorneys will talk to you without charge to determine if there is a case, so there is rarely anything to lose by talking to a lawyer about a car accident case.
