California (2021, November 17) - In 2022, California hopes to increase the total amount you can claim when seeking total disability with your workers' compensation claim. The rates officially go up on January 1.

As of 2021, the maximum total disability payout you can receive per week is $1,356.31. In 2022, however, the California Division of Workers' Compensation raised that amount to $1,538.71. This increase will help several employees who are no longer able to work due to their injuries.

The California Labor code helped lead to this price increase. Under the law, the state has to adjust the total disability payments based on the average weekly wages. These relate to what full-time employees make in a typical week. They compare it to the previous year. For 2022, for instance, they looked at the numbers for the first part of 2021.

More specifically, the Department of Labor of California looked at the last fiscal year that ended on March 31, 2021. For 2023, they will look in-depth at the wages for the time period that ends on March 31, 2022.

The average weekly wages that individuals made in the year that ended on March 31 of 2021 was $1,570. For 2020, however, this amount was $1,383. In total, the Department of Labor reported that this was an increase of over 13%. California should feel ecstatic about these numbers as they show an economic improvement.

It is important to note that individuals already on total disability have the right to adjust their weekly benefits. Anyone who first completed their claim after January 1, 2003, is eligible.
